GENERAL TOS
Disclosure: I (the artist) reserve the right to deny and refund commissions for any reason (rude behavior, violation of TOS, etc.)
Refunds: Refunds are not accepted after the sketch is complete. However if a piece takes longer than six months to finish, the commission will be automatically refunded. Artistic liberty commissions are nonrefundable after they are completed.
Wait Time: Commissions are worked on one at a time in payment order (the exception being convention-pickup commissions and warmup sketches). Start time varies depending on where customers are in the wait queue. When a customer is next in line, they will be contacted and work will begin on the commission. Commissions are usually completed within two weeks to two months depending on the complexity. However, they can sometimes take longer due to life circumstances. My Trello queue is always available for customers to see where they are in line, and also provides updates if there are commission delays.
Hours & Opening Schedule: I work a second job in education, therefore I have limited days and times to work on art. My hours and commission opening schedule are kept up-to-date at www.09leaf.com/hours-and-opening-schedule
Convention Completion: When I take commissions at conventions, only specific commission types can be completed during the convention itself. Other commission types require more time and effort to create. Commissions not finished during the convention will be sent digitally or shipped to the commissioner post-con.
CLIENT USAGE AND ARTISTIC LIBERTIES
Usage: Commissioned art is for personal use only. Customers can use pieces as profile pictures, banners, or post them on social media. "Art by 09Leaf" must be credited and my watermark cannot be removed. Commissioned art cannot be used as merchandise.
Art Theft: Art theft includes claiming to have drawn my art, reposting without credit, reselling my work as merchandise or prints, reselling as NFTs, tracing and referencing without credit, tracing and finishing a refunded sketch, and replicating/feeding my work to AI. Theft is not tolerable, and legal action can be pursued if the issue is not resolved upon initial contact.
Art Style: My drawing techniques may fluctuate to avoid creative burnout. Level of toony-ness, lineart (smooth or textured), shading (soft or cell), background patterns, and traditional mediums might be different from commission to commission. This choice is strictly my artistic liberty. Customers cannot request a commission in an art style that is not my own.
Artistic Liberty: Commissions labeled "artistic liberty" mean that the customer provides a character and I get to draw them however I want. No customer input, no revisions, and no WIP photos. The final piece is a complete surprise!
REQUESTING REVISIONS
Revisions (Traditional): For traditional art (not artistic liberty), customers are allowed to request up to two free revisions only in the sketch. A 15% fee will be charged for each additional revision while sketching. No changes can be requested in further stages because traditional mediums are permanent. Mistakes by the artist are free-of-charge (FOC).
Revisions (Digital): For digital art (not artistic liberty), customers are allowed to request up to two free revisions in either the sketch or lineart. A 15% fee will be charged for each additional revision while sketching and lining, and a 30% fee will be charged for revisions requested past those stages. Mistakes by the artist are FOC.
TRADITIONAL ART INFORMATION
Shipping: Shipping traditional art within the United States of America is $8.00 USD and *international shipping is $18.00 USD. Both come with tracking. If a parcel is lost in the mail, I will remake the same commissioned art provided the customer pays for shipping again.
*Update 4/8/25: international shipping will not be offered until stated otherwise due to the unpredictability of shipping prices and tariffs in the USA economy.
Allergies: I own a large dog, cat, gecko, and feeder insects. I also have frequent interactions with other animals such as ferrets and other reptiles. Although my workspace is clean and primarily free from pets, there is always the possibility of rare pet dander or accidental stray hair in a parcel. If the customer is severely allergic to any of the above, please refrain from purchasing traditional art!
DO'S AND DON'TS
I DO DRAW: Original characters, fandom OCs, anthropomorphic animals, feral animals, fantasy creatures, monsters, pride flags, pets, diverse body types, and religious symbolism/content if it is NOT promoting hate.
I DON'T DRAW: Humans/humanoids, licensed/copyrighted characters, blood, gore, NSFW, suggestive/sexual poses or expressions, smoking, alcohol, drug use, fetish art, exaggerated or fetishized body types/parts (plus sized characters are fine!), political content, country flags, cultural appropriation, zoophilia, pedophilia/loli, mecha, horror, and AI generated reference material.
I will not draw anything that would promote hate or discrimination towards a specific group or individual.
